A number of our clients are Colorado State University students who have either had too much to drink, gotten into a misunderstanding in a consensual sexual relationship, had a fight with a roommate, or all of these. Most commonly the charges are alcohol related, and can have serious consequences for the student in terms of finishing school or, more critically, avoiding felony convictions or sex-offender registration and labeling. The types of crime we represent CSU students on range from simple assault to sexual assault, from too much alcohol to drug use, and from trespassing to theft. In addition to the defense for the underlying criminal charge in County or
District Court, Colorado State
University students face possible additional University disciplinary hearings.
The goal of these hearing is not so much to punish the student (although they
can lead to expulsion from the University), but rather to have the student learn
from and grow from the experience. Competent experience criminal defense legal
counsel can assist in providing preparation for these disciplinary hearings, representation at these hearings, and importantly
to help fashion remedies such as restorative justice that are not so punitive as
is more commonly found in the criminal justice system. Typical crimes charged against students involve alcohol and drug violations,
theft, assault, and sexual assault. Often the sexual assault charges involving
students result from misunderstanding and reasonable and valid beliefs that the
activities were consensual. See further in the Trend section of News, the discussion of pretext
phone calls that serve to entrap the unwary student into making damaging
admissions. |
