Felony Defense
Felony Defense Misdemeanors CSU Juveniles DUI

 

Most of our work is providing our clients with felony defense or defense of serious misdemeanors.  There are six classes of felonies ranging from the most serious, such as first degree murder to the less serious, such as Driving After Revocation Prohibited or Exhibition with a prior conviction.  They all have in common the provision for Department of Corrections (DOC) prison sentences as a possible penalty and are heard in the highest level of trial court in Colorado, the District Court.

The more severe felonies provide for a preliminary hearing which is a screening device used to ensure that there is sufficient evidence to indicate that the case should proceed as is discussed further below.

Felony Overview

bulletInitially commenced with a warrant based on an Information or affidavit, or occasionally by a warrantless arrest.
bulletInitial Bond and Advisement is in County Court in Larimer County and in District Court in Weld County.
bulletSubsequently in Larimer County, arraignment is in District Court (and the ultimate trial, if necessary, will be in District Court).
bulletA Preliminary Hearing is allowed in some cases (depending upon the type and the seriousness of the crime) and can be used to test the sufficiency of the government's case.
bulletTrial is in District Court, usually to a jury, but occasionally to the Court based on trial strategy.
