Felony Defense Misdemeanors CSU Juveniles DUI

Youths charged as juveniles (alternatively they may be charged as adults for more serious crimes such as felonies) appear in a special division of District Court.  In contrast to criminal charges, in juvenile court  the focus is on helping the child while maintaining protection of the public safety and welfare.

Juvenile Defense Overview

bulletAfter arrest, the child may be held in a juvenile facility or released to the custody of the parents or guardians.
bulletA juvenile is entitled to the same Constitutional Rights as are adults (see Legler v. People), such as the ability to refuse to incriminate oneself and to be assisted in any waiver of Constitutional Rights by an aligned (an adult who has the same interests as the juvenile) adult.
bulletOptions for resolution without trial are much more varied and rehabilitative in nature as compared with individuals charged as adults.
bulletThe use of Restorative Justice is also more widely used in juvenile cases.
bulletOften the resolution can include diversion out of the criminal justice system with rehabilitative activities such as community service, and depending on the case, alcohol and drug monitoring.
