Domestic Violence

There are three classes of misdemeanors, ranging from the most serious (Class 1) such as DUI or assault to the least serious (Class 3) such as harassment.  There are also lesser offenses such as petty offenses and traffic infractions.

Perhaps one of the most serious misdemeanors in Colorado is an underlying charge of harassment or assault (or even kidnapping) which is then coupled with what is termed a sentencing enhancer making the charges much more serious.  These charges have serious repercussions and it is recommended that competent legal representation be obtained to assist in the resolution.

Other serious misdemeanors include any crime involving sexual assault because a conviction for this crime requires psychosexual evaluations, treatment, and sexual offender probation.

Misdemeanor Overview

bulletUsually summons or ticket and low bond often with the help of an attorney, a personal recognizance (PR Bond) in which the person promises to pay the bond only if they fail to appear in County Court.
bulletThe first appearance of the defendant can often be waived (not requiring that the defendant appear in court) if they have an attorney representing them.
bulletPretrial conference to determine the issues and look at a possible resolution is conducted with the prosecution.
bulletIf a resolution is not reached, then trial is in County Court, most often to a jury.
